Getting a solid document retention system is one of the first steps. This way you know you have all the relevant information and can then begin your eDiscovery process. Companies like NextPage are out there providing this kind of software, but make no mistake, they're none too cheap.

Many aspects of proactive preparation for litigation can be implemented along with internal data management and retention practices, long before the onset of litigation. Doing so allows corporat;ions to take control of their data, minimize risk and reduce costs, while assuring corporate compliance with federal rules. A strong eDiscovery solutions provider can help you implement the process internally.

I think if you dug deeper, you might find that much of the innovation you credit to Jeff G, particularly with respect to in-house eDiscovery processing, originated with me. Moreover, there was Cisco attorney (initials MM) who should get a large amount of credit for the legal and management side of the Cisco reforms. Ultimately, we would have to thank a young, very smart attorney from a now extinct big SF law firm for giving me the chance to prove the value of the methodology I developed with the assistance of Dan Mares (www.dmares.com).
